Terms
Payments and Delivery
-Payment: Payment in full is required at the time of booking to confirm your appointment. -Delivery: General photo delivery will occur on the next business day following the on-site appointment. Premium edits for home tour videos and reels will be delivered within 48 hours of the on-site appointment. Rush delivery may be available upon request and will incur additional fees, determined on a case-by-case basis. -Non-Refundable Services: Domain name purchases are non-refundable once the URL has been provided.
Reschedules and Cancellations
Reschedule Policy:
-Clients may reschedule with no fee if notice is provided more than 4 hours before the appointment time. -Reschedules made 4 hours or less before the appointment will incur a $35 reschedule fee.
Day-of Appointments:
-If the property is not ready for photography upon entry (e.g., clutter, incomplete staging, or cleaning), clients may choose to: Proceed with the shoot as is: -The shoot will be completed based on the propertyâ??s current condition. -This may result in certain areas of the property being excluded or the media not meeting the quality standards HVM typically delivers. -HVM does not assume liability for the condition of the property, and no refunds will be issued for media produced under these circumstances. Reschedule the shoot: -A $35 reschedule fee will apply, and the appointment will need to be rescheduled to a time when the property is ready. -If the client does not make a choice within the allowed time frame, HVM reserves the right to cancel the shoot, and the full cost of the shoot being forfeited and will not be refunded.
Cancellation Policy:
-Cancellations made 24 hours or less before the appointment without rescheduling will result in the full cost of the shoot being forfeited and will not be refunded. -If rescheduling is required due to unsafe or unsuitable conditions and the client declines to reschedule, or if conditions cannot be adjusted to meet our requirements, the shoot will be canceled, and the full cost of the shoot being forfeited and will not be refunded. Examples: The scenarios listed above are examples only and are not exhaustive. HVM reserves the right to assess and determine the suitability of conditions at its sole discretion.
-Non-Refundable Services: Completed services are non-refundable.
Property and Environmental Conditions
-The client is responsible for ensuring the property is ready for the shoot and accessible at the scheduled time. This includes, but is not limited to, ensuring the property is clean, staged, and in a condition suitable for professional photography. -Animals: All animals must be restrained and kept away from HVM team members and equipment throughout the shoot. -Unsafe Conditions: If property conditions are deemed unsafe or unsuitable for our team or equipment (e.g., temperatures below 60°F or above 80°F inside, ice, snow, rain, or other environmental hazards obstructing access to the property), a reschedule will be required, and a $35 reschedule fee will apply. -If the client declines to reschedule or if the conditions cannot be adjusted to meet our requirements, the shoot will be canceled, and the full cost of the shoot being forfeited and will not be refunded.
Weather
-Commitment to Safety: HVM strives to work in all weather conditions as long as it is safe for our team and equipment. -Weather Concerns: Weather is monitored daily. If rain, snow, ice, or other hazardous conditions are anticipated, HVM will attempt to contact the client to discuss rescheduling. -If the client refuses to reschedule, requires us to proceed with the scheduled appointment, and the shoot cannot safely proceed on the day of the appointment, the shoot will be canceled, and the full cost of the shoot being forfeited and will not be refunded. -Access Issues: If unsafe weather conditions prevent safe access to the property (e.g., ice, snow, or rain obstructing sidewalks, driveways, or pathways), HVM reserves the right to refuse service and require a reschedule. A $35 reschedule fee will apply. Examples: These examples are not exhaustive, and HVM reserves the right to assess weather-related concerns and determine the suitability of conditions at its sole discretion.
Property Access and Shoot Preparation
-Access Responsibility: Clients are solely responsible for ensuring the photographer has full access to the property at the agreed-upon date and time. -Late or Denied Access: If access is not provided within 15 minutes of the scheduled start time (e.g., lockbox issues, missing keys, or other access problems), a $35 reschedule fee will apply, and the shoot will need to be rescheduled. -Property Readiness: If the property is not ready for photography upon entry (e.g., clutter, incomplete cleaning, or staging), clients may choose to proceed as is or reschedule. A reschedule will incur a $35 fee. Shoot Preparation Guide: HVM provides all clients with a Photo Shoot Prep -List, available on our website. -Equipment and Liability: HVM photographers cannot assist with cleaning, staging, or moving personal property due to insurance limitations. However, small items, lighting, and window treatments may be adjusted at the photographer's discretion.
Relationship of Parties
-HVM photographers are independent contractors and not employees of the client. -Neither party shall bind the other except as stated in this agreement. -All services and deliverables provided by HVM photographers are protected under Copyright Law and are not considered work for hire.
